VISITOR PARTICIPATION REGULATIONS

1. Introductory Provisions

1.1. These participation regulations (hereinafter: the “Regulations”) set forth the conditions and rules of participation for visitors (hereinafter: the “Visitor” or “Visitors”) at the Valley of Arts festival (hereinafter: the “Festival” or “Valley”) organized by Művészetek Völgye Nonprofit Limited Liability Company (registered office: 8294 Kapolcs, Kossuth u. 35., company registration number: 19-09-517015) (hereinafter: the “Organizer”), as well as the principal rights and obligations arising from the legal relationship between the Organizer and the Visitors through the purchase of tickets (entry passes, festival passes) (hereinafter jointly: the “Parties”).

1.2. The Organizer draws the Visitors’ attention to the fact that the Valley is a festival held under special circumstances, where private properties (courtyards) open their gates and program venues are located within these courtyards. The daily life of the owners of the courtyards and the surrounding villages hosting festival programs (hereinafter: the “Valley Villages,” i.e., Kapolcs and nearby villages hosting the festival in the given year) is intertwined with the festival. Road traffic passes among festival-goers moving in the streets, and the built environment is arranged according to the owners’ requirements. Consequently, Visitors must exercise extreme caution regarding traffic, property safety, personal safety, and accident prevention, in contrast to festivals held on fully enclosed, festival-dedicated areas.

1.3. Visitors enter the Valley Villages and Festival programs at their own risk. Except for ticketed events organized by the Organizer, the Organizer has no influence over, and disclaims all liability for, any incidents or damages occurring within the Valley Villages.

1.4. Visitors who enter the Valley Villages without purchasing a ticket for ticketed programs do not enter into any legal relationship with the Organizer. Entry into the Valley Villages does not establish any legal relationship, and the Organizer bears no liability for any damages that may occur.

1.5. For the purposes of this Regulation, and pursuant to the Hungarian Civil Code (Act V of 2013), this document qualifies as a set of general terms and conditions (hereinafter: “GTC”). Any reference by law or by a document issued by the Organizer to the Visitors’ GTC shall be understood as referring to these Regulations.

1.6. The current Regulations are available on the website: www.muveszetekvolgye.hu and at all ticketing and information points during the Festival. Visitors are requested to read them carefully prior to purchasing tickets. By purchasing a ticket, the Visitor acknowledges having read and accepts these Regulations as binding.

1.7. By purchasing a ticket, the Visitor consents to being photographed or recorded on video as a participant of the Festival.


2. Content of the Legal Relationship Between the Parties

2.1. In consideration for the purchase of a ticket, the Organizer grants the Visitor access to the Festival programs, and the Visitor undertakes to pay the ticket price to the Organizer.

2.2. The Valley’s programs consist of numerous performances and events realized with the participation of many contributors. The Organizer does not guarantee the occurrence, quality, or attendance of any specific program. Audience seating is on a first-come, first-served basis. If maximum capacity is reached at a venue, the Organizer reserves the right to deny further entry. Visitors shall have no claims in relation to such restrictions.


3. Tickets (Entry Passes, Festival Passes)

3.1. Information on ticket types and prices is available on the Organizer’s website and at ticketing and information points. Ticket prices are determined with regard to the limitations of liability set out in these Regulations.

3.2. Upon purchase, a wristband represents the rights and obligations associated with the ticket. Entry to the Valley Villages is free, but participation in programs is only permitted with a valid wristband.

3.3. Only intact wristbands worn on the wrist authorize participation in programs. Wristbands are checked upon entry by personnel appointed by the Organizer (Valley staff, security personnel).

3.4. Lost, stolen, or damaged wristbands will not be replaced by the Organizer. Wristbands are non-transferable. Damaged wristbands (e.g., re-taped, cut, tampered with, larger than hand size, or passing over the hand) are invalid.

3.5. Entry is free for children up to 6 years of age. If a children’s day ticket is available in a given year, a “child” shall be any person under 18 for the purposes of that ticket.


4. Rights and Obligations of the Parties

4.1. Visitors undertake to behave in accordance with generally accepted rules of social conduct, applicable laws, and these Regulations.

4.2. Visitors shall refrain from any behavior that may endanger or infringe upon the personal rights, life, bodily integrity, or health of others, or that is inconsistent with the spirit of the Valley.

4.3. Visitors undertake to exercise extreme caution regarding traffic, property safety, personal safety, and the safety of others, to avoid accidents, and to refrain from any behavior that could damage Festival venues (courtyards) or the built or natural environment.

4.4. Visitors undertake to fully comply with laws regarding smoking. Visitors expressly agree to reimburse the Organizer for any fines imposed on the Organizer due to the Visitor’s legal violations.

4.5. Visitors acknowledge that beverages purchased outside the Festival may not be brought into program venues.

4.6. Visitors acknowledge that the Organizer and authorized parties may make audio and video recordings during the Festival, and Visitors expressly, freely, and irrevocably consent to unlimited use of such recordings (e.g., publication, adaptation, reproduction, public disclosure, distribution). Visitors shall have no claims against the Organizer regarding these recordings.

4.7. Visitors are permitted to make audio and video recordings within the Valley, but recordings of concerts or programs require the Organizer’s prior written consent.

4.8. Medical services and continuous ambulance presence are provided for Visitors, who are entitled to use these services in accordance with their social insurance status.

4.9. By participating, Visitors expressly agree to cooperate fully with security personnel, civil guards, and Valley staff, and to follow instructions in the event of emergencies.

4.10. The Organizer expressly reserves the right to change the program, venue, or time. Visitors shall have no claims against the Organizer for such changes.

4.11. The Organizer shall be liable only for damages caused intentionally by the Organizer at program venues, or for contractual breaches causing harm to life, bodily integrity, or health, in accordance with mandatory provisions of the Civil Code. The Organizer expressly disclaims liability for all other personal or property damages. Visitors acknowledge that any claims arising under a contract between the Organizer and a venue operator may be enforced directly against the venue operator if provided for in such contract.

4.12. The Organizer is not liable for damage or loss of items placed in designated parking areas, including vehicles and their contents, or any unattended items brought into the Valley.

4.13. The Organizer assumes no liability for products or services provided by vendors, service providers, or other partners. Visitors use these at their own risk. The Organizer is not liable for any damage caused by objects used by such partners in the course of their activities.

4.14. Visitors are fully liable under civil and criminal law for any damages they cause within the Valley, whether to the Organizer or to third parties. The Organizer excludes liability for any damage resulting from the Visitor’s unlawful conduct toward vendors, service providers, or other partners.

4.15. The Organizer provides a value storage service for Visitors’ belongings. Visitors acknowledge that the Organizer is not liable for damage, loss, or theft of items brought to the Festival. Visitors are strongly advised to use the storage facility and not leave valuables unattended.


5. Closing Provisions

5.1. These Regulations apply to the Organizer and Visitors. Relationships between the Organizer and participating artists, vendors, service providers, and venue operators are governed by separate contracts. The Regulations are valid indefinitely from the date of issuance. Visitors acknowledge that the Organizer may unilaterally amend the Regulations.

5.2. Issues not regulated in these Regulations shall be governed by the provisions of the Hungarian Civil Code (Act V of 2013).
